Terms of service.

Welcome to Cloud Shape Interpreting, operated by Cumulus Creatives LLC. By accessing or using our website, mobile applications (including the CloudDrawing app), our community spaces (including our Discord server), our social and video channels, or any of our other services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our Services.

1. Acceptance of Terms

By accessing or using our Services, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use our Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Services

Cloud Shape Interpreting provides:

• An online store for purchasing sealed Pokémon and other trading-card products;
• Mobile applications for creating and sharing cloud-themed artwork (the CloudDrawing app);
• Live shopping shows on third-party platforms (currently Whatnot);
• A community server on Discord, where members can talk with us and with each other and can submit drawings for us to feature ("Community Submissions", see Section 8);
• A drawing-submission form on our website, where you can send us a drawing for us to feature ("Community Submissions", see Section 8);
• Social and video channels— currently YouTube (including Shorts), TikTok, Instagram and Facebook — where we post about our products, our shows and our community, including featured Community Submissions.

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.

Purchases on third-party platforms:Purchases made through our shows or listings on third-party marketplaces (currently Whatnot, TikTok Shop and eBay) are governed by that platform’s terms and dispute-resolution process. The policies on this site apply to purchases made on cloudshapeinterpreting.com.

Community rules:Our Discord server has its own posted rules and Discord’s own Terms of Service and Community Guidelines also apply there. Discord requires its users to be at least 13 years old.

3. User Accounts

Certain features of our Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Orders & Payments

All orders placed through our website are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason. Prices are listed in US dollars and are subject to change without notice. Payment processing is handled securely through Shopify. By placing an order, you agree to provide current, complete, and accurate purchase and account information.

5. Shipping & Delivery

Shipping times and costs are displayed at checkout. We are not responsible for delays caused by the shipping carrier or customs processing. Risk of loss and title for items pass to you upon delivery to the carrier. For full details, please see our Shipping Policy.

6. Returns & Refunds

Returns and refunds are handled in accordance with our Refund Policy. Sealed trading-card products are sold as final sale and are not eligible for return or exchange except in the case of damage in transit. Please review the Refund Policy for full details on eligibility, timeframes, and the return process.

7. Intellectual Property

All content on our Services, including but not limited to text, graphics, logos, images, designs, and software, is the property of Cumulus Creatives LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

Trading-card products sold through our Services are genuine, sealed manufacturer product. Trademarks and copyrights for those products belong to their respective owners (e.g., The Pokémon Company International, Nintendo, Creatures Inc., GAME FREAK Inc.). Cumulus Creatives LLC is not affiliated with, endorsed by, or sponsored by these companies.

8. User-Generated Content

(a) Ownership and license.If you submit, upload, or share content through our Services — including artwork created in the CloudDrawing app and drawings submitted on our Discord server or through the form on our website ("Community Submissions") — you retain ownership of your content. By submitting it, you grant Cumulus Creatives LLCa non-exclusive, royalty-free, worldwide license to use, reproduce, adapt (for example, to cut a drawing out of its background, resize it, animate it, or place it in a video or image), display, and distribute that content in connection with operating and promoting our Services — including featuring it in videos and posts on our social and video channels (such as YouTube Shorts, TikTok, Instagram and Facebook) and cross-posting the same feature across those channels. You represent that you have the right to grant this license and that your content does not violate any third-party rights.

(b) What we ask you to tell us.Both of our submission forms — the one on our Discord server and the one on our website — record the permission statement you agreed to when you submitted. Each form also lets you tell us if you made the drawing with AI tools, and if you do, we show that with your work (see (c)). If you do not tell us, we do not label the work either way and we make no representation about how it was made. Please answer honestly.

(c) Credit.If we feature your submission, we credit it using the credit name you gave on the form — a first name or a nickname. The website form requires one; on Discord, if you leave it blank we use your Discord display name. Where you told us the work was made with AI tools, the on-screen credit says so. We may shorten or format the credit to fit the medium, but we will not credit your work to someone else. We never publish a surname, an age, an age bracket, a location, or account details alongside a submission — from anyone, of any age.

(d) Removing your work (takedown).You may ask us at any time to stop using a submission — contact us (Section 16), or message a moderator on Discord if that is where you submitted. We will stop using it in new features and posts within a reasonable time after your request, and delete it from the set we work from. Content that has already been published (for example, a video that has already gone out) is removed on a best-effort basis: we will take down the post where we control it, but copies, embeds, and platform caches we do not control may persist, and a request does not oblige us to re-cut or re-issue a finished video.

(e) Minors.Discord requires its users to be at least 13. If you are 13 to 17, you may submit your own work with the understanding that we may feature and credit it as described above. The form does not accept submissions from anyone under 13. For any submission by a minor we will credit only a first name or nickname, and we will never display the artist’s age, age bracket, surname, location, or account details.

(f) Moderation.We choose which submissions to feature and may decline any submission for any reason. We do not feature content that is not the submitter’s to give, that includes other people’s trademarks or characters in a way we judge risky, or that breaks our community rules or Section 9.

9. Prohibited Conduct

You agree not to:

• Use our Services for any unlawful purpose
• Interfere with or disrupt the integrity or performance of our Services
• Attempt to gain unauthorized access to any part of our Services
• Upload or transmit viruses, malware, or other harmful code
• Use automated means (bots, scrapers) to access our Services without permission
• Harass, abuse, or harm other users

10. Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the fullest extent permitted by law, Cumulus Creatives LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of our Services. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Cumulus Creatives LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising from your use of our Services or violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New Hampshire.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
